1. Our Agreement
When you book a course a contract is made. You must sign a booking form at the time of making your booking which is your commitment to pay for the whole course. We will give you an invoice at the time of booking. You should check this carefully to see that it matches what you have booked. You must pay a deposit at the time of booking and fill out both a booking and medical form. If any answer on the medical form is a YES then you will need to provide a signed fit to dive medical statement from a doctor before the booking will be accepted. The remainder of the balance is due 14 days before commencement of your course.
If you do not we reserve the right to cancel your booking and ask you to pay a cancellation charge of £50.00
The person signing the booking form accepts responsibility for paying for all the people on the booking. They are also responsible for keeping everyone in the party informed of the booking details. This agreement will be governed by the English law and any disputes will be dealt with by the English Courts.
2. The Course Price
All advertised prices are quoted in pounds sterling. The prices advertised apply at the time of printing and may change before you make your booking. We will confirm the price before you complete the booking. Entrance fees to all open water sites are not included in any quoted course prices. Availability options vary depending on which course you choose. However exceptions will apply. If you change your booking and a change can be made a fee will be charged
3. Our Obligation to You
If we change or cancel a course, we will try to avoid making changes to your course arrangements; however we may need to make changes in some cases as our courses are planned many months in advance. There may be some minor changes made before you’re course starts, if so we will tell you before the start of your course
Occasionally we may have to make major changes, if this is the case we will attempt to make acceptable alternative dates available. We will put you on the next available course. Major changes may include the following. (Please note these are examples only and there may be other changes which constitute major changes). Less than three other people able to attend the course, swimming pool or open water sites become unavailable, Instructors/ assistants become unavailable.
Important Note: Compensation will not apply to circumstances beyond our control. We can cancel your course in the event of the following circumstances: war, riots, civil strike
Terrorist activity, industrial disputes, natural or nuclear disasters, fire, bad weather conditions and similar events beyond our control.
4 Accuracy of Advertised Courses
We will provide the facilities and services advertised by us. If we or our suppliers withdraw those facilities or services or limit them for any reason, we will try to tell you and where appropriate pay you compensation for events, which are outside our or our suppliers control... We will do our best to keep you informed of any changes of which we are aware.
5. Your Obligation to Us
If you want to cancel your booking after we have accepted it, the person who signed the booking form must send signed instructions to us. If you cancel your booking we will ask you to pay cancellation charges minimum of £50 per person. This charge reflects our estimated loss as a result of dealing with your booking to the point of cancellation and any other losses we may have to pay.
6 If you want to change you’re booking
In the event that you are prevented from proceeding with any course for reasons beyond your control, and not simply due to a change of mind, we will allow you to change your booking up to fourteen days before the start of the course and would require written confirmation on the reason which prevented you from starting the course to consider such an amendment. If you want to change your course in any way we will try to help you, although we cannot guarantee we will always be able to do this as changes are subject to availability at the time. Where we can make such a change we will charge an amendment fee for each person on the booking. You will also need to pay any difference in the course price, which results from such a requested change. You may change your course date only once.
7 Behaviour
We can end your course if your behaviour or that of any member of your party is likely in our opinion to cause distress, damage, danger or to annoy our other customers, employees or anyone else. If you are prevented from diving because any person in authority thinks you appear to be unfit to dive or likely to cause discomfort to or disturb other divers ,we will not be liable to complete your course arrangements and will be not liable for a refund, compensation or any other costs you have to pay. We cannot accept liability for the behaviour of others on your course or if any of the facilities are removed because of their actions.
8 If you have a problem
If you have a problem while you are on a course, you must report it immediately to one of our representatives who will try to prevent your course being spoilt. There may be occasions where at time of booking we agree to changes to the correct terms. Other than this, no changes to the terms of the contract, which includes any statement s appearing in any advertising, including descriptions of any course without our specific agreement. You need to take all reasonable care to protect yourself and your property. We will not accept responsibility for any personal items of any customer whilst on our premises or participating in any of our courses.
